What is Power of Attorney?

A Power of Attorney is a legal document in which you authorise others who you have chosen and trust – known as your Attorney (or Attorneys if you choose more than one) – to act on your behalf in respect of your property or financial affairs.

A Power of Attorney can only be created whilst you are mentally capable of making decisions and fully understand what you’re doing.

You can decide that it should ‘Endure’ (continue) if you lose the mental capacity to make your own decisions at some time in the future. This is called an Enduring Power of Attorney and only has to be registered with the Isle of Man Courts when the person giving the authorisation (who is known as the Donor) has been formally assessed by a Medical Practitioner as losing or having lost mental capacity.

Why is an Enduring Power of Attorney important?

None of us know what tomorrow will bring and sudden illness or accident could leave any of us in the position of not being able to manage our finances ourselves. Additionally, an increasing number of Isle of Man residents are developing dementia type symptoms, yet their loving relatives are unable to simply go into a bank and access their money in order to pay for their care or living expenses unless an Enduring Power of Attorney has been put in place beforehand.

Having an Enduring Power of Attorney in place will ensure that you have the reassurance and peace of mind to know that if you’re not able to continue to manage your affairs, they can be managed on your behalf by someone who you have appointed and trust.

If someone loses mental capacity without an Enduring Power of Attorney having been put in place, a relative may have to apply to the Courts for more complicated and expensive Mental Health Receivership.

About Us

Power of Attorney IOM was founded and is operated by Nigel Shimmin, formerly a long-serving local Police Inspector and Senior Paralegal within a local legal practice. Nigel was responsible for managing the affairs of vulnerable people who were unable to do so themselves whilst working in the legal practice and this is where his interest in Powers of Attorney and Mental Health Receivership was borne. The experience and knowledge gained in these fields, along with a passionate belief that we should all have an Enduring Power of Attorney in place as none of us know what tomorrow will bring, led to the formation of Power of Attorney IOM.

Nigel has provided training to local Care Home managers on the importance of Powers of Attorney and how to put them in place.
